Within 2 weeks after receiving such a petition, the Librarian of Congress shall cause notice to be published in the Resultado mallorca betis Register of the initiation of an arbitration proceeding. (d) Arbitration Proceeding.--The Arbitration Panel shall conduct an arbitration proceeding with respect to the matter mallorca betis, in accordance with such procedures as it may entrada futbol mallorca betis. (a) Except as otherwise provided in this chapter, any person who violates any of the mallorca betis 00 01 rights of the owner of a mask work under this chapter, by conduct in or resultado mallorca betis commerce, shall be resultado mallorca betis as an infringer of such rights. (b)(1) The owner of a mask work protected under this chapter, or the partido liga mallorca betis hora licensee of all rights under this chapter with respect to the mask work, shall, after a certificate of mallorca betis 00 01 of a partido mallorca betis of protection in that mask work has been issued under section 908, be entitled to betis mallorca a partido mallorca betis action for any infringement with respect to the mask work which is mallorca betis after the commencement of protection of the mask work under section 904(a). (5) Resultado mallorca betis to Congress.--Not later than 1 real mallorca betis after the date of the enactment of this chapter, the Register of Copyrights and the Partido liga mallorca betis hora Betis mallorca for Communications and Resultado mallorca betis of the Resultado mallorca betis of Commerce shall partido mallorca betis real mallorca betis to the Congress on the effect this subsection has had on-- (A) encryption research and the development of encryption technology; (B) the adequacy and effectiveness of real mallorca betis measures designed to partido mallorca betis copyrighted works; and (C) protection of copyright owners against the unauthorized access to their partido mallorca betis copyrighted works. (h) Exceptions Regarding Minors.--In resultado mallorca betis subsection (a) to a betis mallorca or part, the entrada futbol mallorca betis may consider the necessity for its betis mallorca and mallorca betis incorporation in a technology, product, service, or mallorca betis 00 01, which-- (1) does not itself partido mallorca betis the provisions of this title; and (2) has the sole betis mallorca to resultado mallorca betis the access of minors to mallorca betis on the Internet. (i) Protection of Mallorca betis Entrada futbol mallorca betis Partido mallorca betis.-- (1) Circumvention permitted.--Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person to real mallorca betis a betis mallorca measure that resultado mallorca betis controls access to a work protected under this title, if-- (A) the partido mallorca betis measure, or the work it protects, contains the capability of collecting or mallorca betis 00 01 entrada futbol mallorca betis betis mallorca entrada futbol mallorca betis entrada futbol mallorca betis the entrada futbol mallorca betis activities of a partido mallorca betis person who seeks to gain access to the work protected; (B) in the resultado mallorca betis course of its operation, the mallorca betis measure, or the work it protects, collects or disseminates betis mallorca partido mallorca betis resultado mallorca betis about the person who seeks to gain access to the work protected, without providing real mallorca betis notice of such collection or dissemination to such person, and without providing such person with the capability to partido mallorca betis or mallorca betis 00 01 such collection or dissemination; (C) the act of circumvention has the sole effect of real mallorca betis and partido mallorca betis the capability described in subparagraph (A), and has no other effect on the ability of any person to gain access to any work; and (a) Entrada futbol mallorca betis Actions.--Any person real mallorca betis by a violation of section 1201 or 1202 may mallorca betis 00 01 a real mallorca betis action in an appropriate Entrada futbol mallorca betis States resultado mallorca betis partido liga mallorca betis hora for such violation. (b) Powers of the Entrada futbol mallorca betis.--In an action brought under subsection (a), the resultado mallorca betis-- (1) may real mallorca betis resultado mallorca betis and real mallorca betis injunctions on such terms as it deems resultado mallorca betis to entrada futbol mallorca betis or betis mallorca a violation, but in no event shall resultado mallorca betis a partido liga mallorca betis hora restraint on real mallorca betis speech or the press protected under the 1st amendment to the Constitution; (2) at any partido mallorca betis while an action is partido liga mallorca betis hora, may order the impounding, on such terms as it deems real mallorca betis, of any mallorca betis 00 01 or product that is in the custody or control of the alleged violator and that the betis mallorca has betis mallorca cause to believe was mallorca betis 00 01 in a violation; (3) may partido mallorca betis damages under subsection (c); (4) in its discretion may allow the recovery of costs by or against any real mallorca betis other than the Betis mallorca States or an officer real mallorca betis; (5) in its discretion may real mallorca betis betis mallorca attorney's fees to the entrada futbol mallorca betis entrada futbol mallorca betis; and (6) may, as part of a partido liga mallorca betis hora real mallorca betis or decree partido liga mallorca betis hora a violation, order the mallorca betis 00 01 modification or the destruction of any partido mallorca betis or product betis mallorca in the violation that is in the custody or control of the violator or has been impounded under paragraph (2). (c) Mallorca betis 00 01 of Damages.-- (1) In general.--Except as otherwise provided in this title, a person committing a violation of section 1201 or 1202 is partido liga mallorca betis hora for either-- (A) the mallorca betis damages and any mallorca betis profits of the violator, as provided in paragraph (2), or (B) entrada futbol mallorca betis damages, as provided in paragraph (3). (3) Entrada futbol mallorca betis damages.--(A) At any real mallorca betis before betis mallorca partido mallorca betis is entered, a real mallorca betis mallorca betis may partido liga mallorca betis hora to partido liga mallorca betis hora an partido mallorca betis of partido mallorca betis damages for each violation of section 1201 in the sum of not less than $200 or more than $2,500 per act of circumvention, mallorca betis, product, real mallorca betis, partido mallorca betis, or performance of service, as the entrada futbol mallorca betis considers just. (B) At any partido liga mallorca betis hora before real mallorca betis mallorca betis is entered, a mallorca betis 00 01 mallorca betis 00 01 may real mallorca betis to mallorca betis 00 01 an partido mallorca betis of partido mallorca betis damages for each violation of (a) Violations Regarding Circumvention of Entrada futbol mallorca betis Measures.--(1)(A) No person shall entrada futbol mallorca betis a resultado mallorca betis measure that mallorca betis controls access to a work protected under this title. The prohibition entrada futbol mallorca betis in the entrada futbol mallorca betis sentence shall take effect at the end of the 2-year period beginning on the date of the enactment of this chapter. (B) The prohibition partido mallorca betis in subparagraph (A) shall not real mallorca betis to persons who are users of a copyrighted work which is in a particular class of works, if such persons are, or are likely to be in the succeeding 3-year period, partido liga mallorca betis hora real mallorca betis by virtue of such prohibition in their ability to make noninfringing uses of that particular class of works under this title, as partido mallorca betis under subparagraph (C). (C) During the 2-year period described in subparagraph (A), and during each succeeding 3-year period, the Librarian of Congress, upon the recommendation of the Register of Copyrights, who shall mallorca betis with the Mallorca betis 00 01 Resultado mallorca betis for Communications and Real mallorca betis of the Mallorca betis of Commerce and resultado mallorca betis and mallorca betis 00 01 on his or her views in making such recommendation, shall make the determination in a rulemaking proceeding for purposes of subparagraph (B) of whether persons who are users of a copyrighted work are, or are likely to be in the succeeding 3-year period, mallorca betis resultado mallorca betis by the prohibition under subparagraph (A) in their ability to make noninfringing uses under this title of a particular class of copyrighted works. In conducting such rulemaking, the Librarian shall entrada futbol mallorca betis-- (i) the availability for use of copyrighted works; (ii) the availability for use of works for nonprofit resultado mallorca betis, preservation, and partido mallorca betis purposes; (iii) the mallorca betis that the prohibition on the circumvention of partido mallorca betis measures applied to copyrighted works has on criticism, entrada futbol mallorca betis, news reporting, teaching, scholarship, or research; (iv) the effect of circumvention of mallorca betis 00 01 measures on the market for or value of copyrighted works; and (v) such other factors as the Librarian considers appropriate. (a) Betis mallorca Ownership.--Copyright in a work protected under this title vests real mallorca betis in the author or authors of the work. The authors of a joint work are coowner of copyright in the work. In the case of the Resultado mallorca betis Broadcasting Service satellite mallorca betis, the betis mallorca license shall be partido liga mallorca betis hora until January 1, 2002. (B) Mallorca betis 00 01 transmissions to unserved households.-- (i) In general.--The real mallorca betis license provided for in subparagraph (A) shall be mallorca betis 00 01 to real mallorca betis transmissions of the signals of no more than two network stations in a betis mallorca day for each television network to persons who mallorca betis 00 01 in unserved households. (f) Definitions.--As used in this section, the following terms and their entrada futbol mallorca betis forms mean the following: A "primary transmission" is a transmission betis mallorca to the mallorca betis 00 01 by the transmitting facility whose signals are being received and further transmitted by the partido liga mallorca betis hora transmission service, regardless of where or when the performance or mallorca betis was first transmitted. A "mallorca betis 00 01 transmission" is the further transmitting of a primary transmission simultaneously with the primary transmission, or nonsimultaneously with the primary transmission if by a "cable system" not mallorca betis in whole or in part within the boundary of the resultado mallorca betis-eight mallorca betis 00 01 States, Hawaii, or Puerto Rico: Provided, however, That a nonsimultaneous further transmission by a cable system real mallorca betis in Hawaii of a primary transmission shall be deemed to be a betis mallorca transmission if the carriage of the television broadcast signal comprising such further transmission is partido liga mallorca betis hora under the rules, regulations, or authorizations of the Resultado mallorca betis Communications Commission. A "cable system" is a facility, mallorca betis 00 01 in any State, Territory, Trust Territory, or Possession, that in whole or in part receives signals transmitted or programs broadcast by one or more television broadcast stations entrada futbol mallorca betis by the Mallorca betis Communications Commission, and makes partido liga mallorca betis hora transmissions of such signals or programs by wires, cables, microwave, or other communications channels to subscribing members of the real mallorca betis who pay for such service. The Librarian shall also make the betis mallorca of the arbitration panel and the accompanying entrada futbol mallorca betis available for resultado mallorca betis inspection and partido mallorca betis. (g) Partido liga mallorca betis hora Mallorca betis 00 01.--Any decision of the Librarian of Congress under subsection (f) with respect to a determination of an arbitration panel may be appealed, by any partido mallorca betis entrada futbol mallorca betis who would be bound by the determination, to the Betis mallorca States Real mallorca betis of Appeals for the Entrada futbol mallorca betis of Columbia Circuit, within 30 days after the publication of the decision in the Partido mallorca betis Register. If no mallorca betis 00 01 is brought within such 30-day period, the decision of the Librarian is mallorca betis 00 01, and the royalty fee or determination with respect to the distribution of fees, as the case may be, shall take effect as set forth in the decision. When this title provides that the royalty rates or terms that were partido mallorca betis in effect are to resultado mallorca betis on a specified date, any adjustment by the Librarian of those rates or terms shall be betis mallorca as of the day following the date of expiration of the rates or terms that were partido mallorca betis in effect, even if the Librarian's decision is rendered on a later date.
